Throughout these Terms & Conditions, references to “Plush Place”, “we”, “us” and “our” mean Heidi Pittman trading as Plush Place.
These Terms & Conditions apply to your use of our website and to orders placed with Plush Place.
Please read them carefully before placing an order.
Nothing in these Terms & Conditions affects your statutory rights as a consumer.
2. Using Our Website
You may use our website for lawful purposes only.
You must not use the website:
- in any way that breaches applicable law;
- to transmit viruses, malware or other harmful code;
- to attempt to gain unauthorised access to the website or systems connected to it;
- to misuse, copy or reproduce our website content for commercial purposes without our permission; or
- in any way that infringes the rights of Plush Place or any third party.
We may suspend or restrict access to the website where reasonably necessary, including for maintenance, security or technical reasons.
3. Our Products
We take reasonable care to ensure that product descriptions, photographs, dimensions, prices and other information shown on our website are accurate.
Images are provided to help illustrate our products. Although we make every effort to display colours accurately, the colour displayed on your device may vary slightly from the actual product.
Any measurements stated on the website should be treated as approximate unless we specifically state otherwise.
All products are subject to availability.
If a product becomes unavailable after you have placed an order, we will contact you as soon as reasonably possible and either offer an appropriate alternative, where suitable, or provide a refund for the unavailable item.
4. Prices and VAT
All prices shown on our website are in pounds sterling (£).
Unless specifically stated otherwise, prices displayed to consumers include VAT at the applicable rate.
Delivery charges are additional unless expressly included in the product price. Any applicable delivery charge will be shown before you complete your order.
We may change our prices at any time, but changes will not affect orders that we have already accepted.
Pricing Errors
We take reasonable care to ensure that prices displayed on our website are correct.
If we discover an obvious pricing error before your order has been dispatched, we may contact you and give you the option of purchasing the product at the correct price or cancelling your order.
If we are unable to contact you, we may cancel the affected order and refund any amount you have already paid.
5. Placing an Order
When you place an order through our website, you are offering to purchase the products in your basket in accordance with these Terms & Conditions.
You will have an opportunity to check and correct your order before completing payment.
After your order is submitted, we may send you an order acknowledgement. This confirms that we have received your order but does not necessarily mean that we have accepted it.
When Your Order Is Accepted
Our acceptance of your order takes place when we dispatch the goods to you.
At that point, a contract between you and Plush Place is formed.
If your order contains several products that are dispatched separately, a separate contract may be formed for each product when that product is dispatched.
We reserve the right to decline or cancel an order before dispatch where reasonably necessary, including where:
- an item is unavailable;
- we are unable to obtain authorisation for payment;
- there is an obvious error in the price or product description;
- we reasonably suspect fraudulent or unauthorised activity;
- you do not meet any eligibility requirements stated for a product; or
- we are unable to deliver to the address provided.
If we cancel an order after you have paid but before the goods are dispatched, we will refund the amount paid for the cancelled goods.
6. Payment
Payment must be made using one of the payment methods offered during checkout.
By submitting payment details, you confirm that you are authorised to use the payment method provided.
Payment will normally be taken when your order is placed unless otherwise stated during checkout.
Payment processing may be carried out by third-party payment providers and will also be subject to their applicable terms and privacy arrangements.
7. Pre-Orders
Certain products may occasionally be offered for pre-order.
The expected availability or dispatch date shown for a pre-order product is an estimate and may change due to circumstances outside our reasonable control.
Our normal aim is to dispatch pre-order items within the timeframe stated on the relevant product page or in our Delivery Policy.
If there is a significant delay to a pre-order, we will endeavour to let you know and provide appropriate options, including cancellation and a refund where applicable.
8. Delivery
Our delivery options, charges and expected dispatch times are set out in our separate Delivery Policy and during checkout.
We aim to dispatch orders promptly, but delivery dates and times are estimates unless we expressly agree otherwise.
Please ensure that the delivery address and contact information supplied with your order are complete and accurate.
If your order is delayed because of an event outside our reasonable control, we will take reasonable steps to minimise the effect of the delay and will contact you where appropriate.
Nothing in this section affects your statutory rights regarding delivery.
Responsibility for the Goods
The goods become your responsibility when they are delivered to you, or to a person identified by you to receive them.
Ownership of the goods passes to you once we have received payment in full.
9. Cancelling an Order and Changing Your Mind
If you are purchasing as a consumer online, you will normally have a legal right to change your mind and cancel your purchase.
For most goods, you have 14 days from the day you receive them to tell us that you wish to cancel.
Once you have told us that you wish to cancel, you then normally have a further 14 days to return the goods to us.
Full details of how to cancel an order, return products and obtain a refund are set out in our separate Returns Policy.
Where required by law, we will also refund the cost of our standard outbound delivery service.
If you selected a more expensive delivery option, such as express or premium delivery, we will only be required to refund an amount equivalent to our standard delivery charge.
Unless goods are faulty, damaged, incorrectly supplied or not as described, you will normally be responsible for the cost of returning them.
You are entitled to inspect products as you reasonably would in a shop. We may reduce a refund to reflect any reduction in value caused by handling beyond what is reasonably necessary to establish the nature, characteristics and condition of the product.
Products That Cannot Normally Be Cancelled
The legal right to change your mind does not apply to certain categories of goods, including goods that are made to your specifications or are clearly personalised, where the relevant legal exemption applies.
Where a product is excluded from the normal cancellation right, we will endeavour to make this clear before you place your order.
These exceptions do not affect your rights where a product is faulty, damaged or not as described.
10. Faulty, Damaged or Incorrect Goods
We are under a legal duty to supply goods that are as described, fit for purpose and of satisfactory quality.
If you receive an item that is faulty, damaged, incorrectly supplied or not as described, please contact us as soon as possible at help@plushplace.co.uk.
Depending on the circumstances and your legal rights, you may be entitled to a repair, replacement, price reduction or refund.
Please see our Returns Policy for further information.
Nothing in these Terms & Conditions limits or excludes your statutory rights.
11. Returns and Refunds
Our Returns Policy forms part of these Terms & Conditions and explains:
- how to tell us that you wish to cancel;
- how and where to return products;
- return postage arrangements;
- when refunds will be processed;
- exchanges;
- faulty or damaged goods; and
- any products that are excluded from change-of-mind returns.
Where these Terms & Conditions or our Returns Policy provide you with greater rights than the law requires, those additional rights will also apply.
12. Promotions and Discount Codes
From time to time, we may offer promotional prices, discount codes or other special offers.
Additional conditions may apply to individual promotions and will be made clear when the promotion is offered.
Unless otherwise stated:
- promotional codes cannot be exchanged for cash;
- only one promotional code may be used per order;
- offers are subject to availability; and
- promotional offers may have an expiry date.
Promotions do not affect your statutory consumer rights.
13. Our Responsibility to You
We are responsible to you for foreseeable loss or damage caused by our breach of these Terms & Conditions or by our failure to use reasonable care and skill.
Loss or damage is foreseeable if it is an obvious consequence of our breach or if both you and Plush Place knew that it might happen when the contract was formed.
If you are purchasing products as a consumer, we supply them for private and domestic use unless otherwise agreed.
We will not be responsible for business losses such as loss of profits, loss of business, loss of opportunity or business interruption arising from a consumer purchase.
Nothing in these Terms & Conditions excludes or limits our liability where it would be unlawful to do so, including liability for:
- death or personal injury caused by negligence;
- fraud or fraudulent misrepresentation; or
- your statutory rights relating to faulty goods, goods that are not as described or goods that we do not have the right to sell.
14. Business Customers
Some Plush Place products may also be purchased by businesses.
If you purchase goods wholly or mainly for purposes connected with your trade, business, craft or profession, you are purchasing as a business customer rather than as a consumer.
Certain consumer rights referred to in these Terms & Conditions, including the statutory 14-day change-of-mind cancellation right, do not apply to business purchases.
Nothing in these Terms & Conditions is intended to give a business customer statutory consumer rights that do not otherwise apply.
15. Intellectual Property
Unless otherwise stated, the content of the Plush Place website, including our own text, graphics, photography, designs, logos and branding, is owned by or licensed to Plush Place and is protected by applicable intellectual property law.
Third-party product names, logos, trademarks and other intellectual property remain the property of their respective owners.
You may view and use the website for personal, non-commercial purposes.
You must not reproduce, republish, distribute, commercially exploit or modify our website content without prior written permission from Plush Place or the relevant rights holder.
16. Third-Party Websites
Our website may contain links to websites operated by third parties.
These links are provided for convenience and information only.
We do not control third-party websites and are not responsible for their content, availability, security, privacy practices or the products or services offered through them.
Your use of a third-party website will be subject to that website's own terms and policies.
17. Personal Information and Privacy
We handle personal information in accordance with our Privacy Policy and applicable data-protection law.
Our Privacy Policy explains what personal information we collect, why we collect it, how it is used and the rights available to you.
18. Changes to These Terms
We may update these Terms & Conditions from time to time, for example to reflect changes to our business, website or applicable law.
The Terms & Conditions that apply to your purchase will normally be those in force when you place your order.
Changes made after an order has been accepted will not retrospectively alter your contract unless required by law or agreed with you.
The latest version of these Terms & Conditions will be available on our website.
19. If Part of These Terms Is Unenforceable
If any provision of these Terms & Conditions is found to be unlawful or unenforceable, that provision will be treated as removed or modified only to the extent necessary.
The remaining provisions will continue to apply.
20. Governing Law and Courts
These Terms & Conditions and contracts between you and Plush Place are governed by the laws of England and Wales.
If you are a consumer, nothing in this section affects any mandatory legal protections available to you under the law of the part of the United Kingdom in which you live.
If you live in England or Wales, you may bring legal proceedings in the courts of England and Wales.
If you live in Scotland or Northern Ireland, you may also be entitled to bring proceedings in your local courts.
21. Complaints and Contacting Us
We want you to be happy with your Plush Place experience.
If you have a question, concern or complaint relating to an order, please contact us and we will do our best to resolve it promptly.
